Definition of biocidal products under the BPR

Biocidal products are defined in Article 3 (1) a) of the BPR as:

 

"any substance or mixture, in the form in which it is supplied to the user, consisting of, containing or generating one or more active substances, with the intention of destroying, deterring, rendering harmless, preventing the action of, or otherwise exerting a controlling effect on, any harmful organism by any means other than mere physical or mechanical action, "

and

 

"any substance or mixture, generated from substances or mixtures which do not themselves fall under the first indent, to be used with the intention of destroying, deterring, rendering harmless, preventing the action of, or otherwise exerting a controlling effect on, any harmful organism by any means other than mere physical or mechanical action.. "

According european regulation EU 528/2012 biocidal products are classified into 22 biocidal product-types, grouped in 4 categories:

 

  • Disinfectants (PT 1-5)

  • Preservatives (PT 6 - 13)

  • Pest control (PT 14-20)

  • Other biocidal products (PT 21 and 22)

Extra information:

Originally there were 23 types of products.

Since  BPR get in force on September 1, 2013 the former product type 20 "Protective agents for food and feed" did no no longer apply.

In germany, it i snot allowed to use biocidal products  in regard of combating birds, fish and other vertebrates for reasons of animal welfare law. They may not be approved or registered. Foreign approvals or registrations of such products may not be recognized.
